Yachty is a marine services and vessel management platform operated by Mzyk Marine Pty Ltd, a South African company. When you use Yachty, we act as the responsible party (operator) for your personal information as defined under the Protection of Personal Information Act, 2013 (POPIA).

For users in the European Union or UK, Mzyk Marine Pty Ltd acts as the data controller as defined under the General Data Protection Regulation (GDPR).

We collect information you provide directly to us, including:

• Account details (name, email address, password)
• Vessel information (name, registration number, type, make/model)
• Location data associated with your vessel (when you use Trip Logger or vessel tracking features)
• Booking and service request details
• Communications you send us through the platform
• Payment information (processed securely by our payment providers — we do not store card details)

We also collect information automatically, including:

• Log data (IP address, browser type, pages visited, timestamps)
• Device information (screen size, operating system)
• Cookie and tracking data (see our Cookie Policy)

We use your information to:

• Provide and improve the Yachty platform and its features
• Process bookings and facilitate connections between vessel owners and service providers
• Send notifications relevant to your bookings, vessel, and account
• Maintain marina logbook and vessel check records
• Communicate platform updates, changes, and relevant offers
• Detect and prevent fraud or misuse of the platform

We process your personal information on the following legal grounds:

• Contract performance — processing necessary to provide you the Yachty service
• Consent — where you have given us explicit permission (e.g., marketing communications, Beta participation)
• Legitimate interests — to improve our platform and ensure security
• Legal obligation — where required by POPIA, ECTA, or applicable maritime law

We do not sell your personal data. We share your information only in the following circumstances:

• With service providers or marinas, to the extent needed to fulfil a booking you have made
• With trusted third-party service providers who process data on our behalf (e.g. email, payments, hosting) under strict data processing agreements
• Where required by law or a valid court order
• With your explicit consent in any other case

We retain your personal information for as long as your account is active, or as necessary to provide you our services. After account closure, we retain data for up to 5 years where required for legal, regulatory, or dispute-resolution purposes, after which it is securely deleted.

We implement appropriate technical and organisational measures to protect your personal information against unauthorised access, loss, or disclosure, in accordance with POPIA Section 19 and GDPR Article 32. This includes encryption in transit (TLS), access controls, and regular security reviews.

In the event of a personal data breach, we will notify affected users and the Information Regulator (South Africa) or relevant supervisory authority (EU) as required by law.

You have the right to:

• Access — request a copy of the personal data we hold about you
• Correction — request correction of inaccurate or incomplete data
• Deletion — request erasure of your data where there is no legal basis for continued processing
• Objection — object to processing based on legitimate interests
• Portability — receive your data in a structured, machine-readable format (GDPR users)
• Withdraw consent — at any time, without affecting the lawfulness of prior processing
